3AHVAC Terms & Conditions

By accessing our website or booking a service with 3AHVAC, you agree to the Terms & Conditions below. If you do not agree, please discontinue use of the site and our services.

1) Use of the Website

  1. Authorized Use. You may use this site to learn about 3AHVAC’s services and to contact us for quotes, subject to these Terms.
  2. Prohibited Conduct. You agree not to: (a) infringe any intellectual property or privacy rights; (b) upload malware or interfere with the site; (c) submit false, misleading, or illegal content; (d) scrape, crawl, or harvest data without written consent.
  3. Third-Party Links. The site may contain links to third-party sites. 3AHVAC is not responsible for their content, security, or practices.
  4. Availability. The site is provided on an “as available” basis and may be updated, suspended, or discontinued without notice.

2) Services, Quotes & Scheduling

  1. Service Descriptions. We strive for accuracy, but descriptions, photos, and specs on the site are for general information only and may change.
  2. Estimates. Any estimate (verbal or written) is based on information available at the time and is not a final price. Final pricing will be stated on your written proposal/contract (“Work Order”) after a site visit and any required load calculation.
  3. Change Orders. Unforeseen conditions (e.g., hidden wiring/plumbing, structural issues, asbestos, panel upgrades, code upgrades) may require a change order and additional charges agreed in writing.
  4. Deposits & Payment. Deposits, progress payments, and final payments are due as specified in your Work Order. Late balances may incur reasonable late fees, collection costs, and interest as allowed by law.
  5. Rescheduling & Cancellations. Please notify us as early as possible. Fees may apply for last-minute cancellations, special-order equipment, or work already performed (see your Work Order for details).
  6. Access. You must provide safe access to the property (including mechanical rooms, roof, outdoor pad) and ensure pets/children are kept clear of the work area.

3) Site Conditions, Permits & Inspections

  1. Code Compliance. We perform work in accordance with applicable codes and manufacturer instructions. Where required, we will assist with permits and inspections as stated in your Work Order.
  2. Electrical Capacity. Adequate panel capacity is required for new equipment. If upgrades are needed, they will be quoted separately.
  3. Hazardous Materials. 3AHVAC does not perform hazardous material abatement (e.g., asbestos, lead). Discovery of such materials may pause work until a licensed abatement contractor remediates.
  4. Weather & Force Majeure. Severe weather, supply chain issues, governmental actions, or events beyond our control may impact scheduling. We will communicate and reschedule as needed.

4) Rebates, Financing & Promotions

  1. Utility Rebates. Rebates are administered by third parties (e.g., Con Edison, PSEG Long Island, Orange & Rockland). Eligibility, amounts, and approval timelines vary by program, equipment efficiency, location, and income tier. 3AHVAC can assist with documentation but cannot guarantee approval or exact amounts.
  2. Program Changes. Utility and government programs may change or end without notice. Final determination is made by the program administrator.
  3. Financing. If financing is offered (e.g., via GoodLeap or other partners), loan terms are determined by the lender. Credit decisions are not made by 3AHVAC. Read lender disclosures carefully.
  4. Promotions. Any promotional offer is subject to stated terms and cannot be combined unless expressly permitted.

5) Warranties & Disclaimers

  1. Manufacturer Warranty. Equipment is covered by the manufacturer’s warranty, subject to registration, maintenance, and other conditions set by the manufacturer.
  2. Workmanship Warranty. If provided, workmanship warranty terms (scope/duration/exclusions) will be stated in your Work Order. Misuse, lack of maintenance, acts of God, and third-party alterations are excluded.
  3. Maintenance. Regular maintenance is required for performance and warranty validity. Ask us about maintenance plans.
  4. Website Disclaimer. The website and its content are provided “as is” without warranties of any kind, express or implied.

6) Limitation of Liability

To the maximum extent permitted by law, 3AHVAC and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, nor any loss of profits, revenue, data, or use, arising out of or related to the website or services. In any event, 3AHVAC’s total liability shall not exceed the amounts you paid to 3AHVAC for the specific project giving rise to the claim.

7) Intellectual Property

All content on this site (text, images, graphics, logos, trademarks) is owned by or licensed to 3AHVAC and protected by applicable laws. You may not copy, modify, reproduce, or distribute any content without our prior written consent.

8) Reviews & User Content

By submitting reviews, photos, or feedback to us or on our platforms, you grant 3AHVAC a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content for marketing and service improvement, in accordance with applicable law and our Privacy Policy.

9) Privacy

Your personal information is handled under our Privacy Policy. By using the site or our services, you consent to the collection and use of information as described therein.

10) Governing Law & Dispute Resolution

These Terms and any dispute arising out of or relating to the site or services shall be governed by the laws of the State of New York, without regard to its conflicts of law rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in New York County, New York.

11) Miscellaneous

  • Changes to Terms. We may update these Terms at any time by posting a revised version on this page with a new “Last Edited” date. Continued use constitutes acceptance.
  • Entire Agreement. These Terms, together with your Work Order and our Privacy Policy, constitute the entire agreement regarding the subject matter.
  • Severability. If any provision is found invalid, the remaining provisions remain in full force.
  • No Waiver. Any failure to enforce a right is not a waiver of future enforcement.
  • Assignment. You may not assign your rights or obligations without our written consent.
  • Language. For convenience, translations may be provided; however, the English version controls in case of conflict.
